Hospitals, health systems, physicians, and outpatient services providers depend on Colin Luke for assistance with regulatory compliance matters involving the federal Anti-Kickback Statute and Stark law, HIPAA and patient privacy, state healthcare regulations, and the development of effective corporate compliance programs. Healthcare clients also rely on Colin for assistance with operations issues such as provider and payor certifications, facility licensure, and certificates of need. Additionally, he is highly sought-after for his experience with a wide range of transactional matters including the acquisition and divestiture of healthcare facilities and the formation of healthcare joint ventures. Colin leads Waller's Healthcare Compliance and Operations practice which comprises nearly 30 attorneys and paralegals who focus exclusively on the complex federal and state regulations governing the healthcare industry.

Prior to joining Waller, Colin represented healthcare providers in the Southeast as a partner with two Birmingham, Alabama law firms. Earlier in his career, he served as Vice President and Corporate Counsel for Active Services Corporation, one of the nation's largest providers of adult day healthcare services. In this role, Colin managed the acquisition and development of healthcare facilities and oversaw the company’s regulatory compliance program.

The former chair of the Alabama Bar’s Health Law Section, Colin has earned a reputation as a leader in his field. He has been recognized among the "Top Attorneys in Alabama" by Business Alabama, named “Best of the Bar” and “Who’s Who in Health Care” by the Birmingham Business Journal, and listed in Best Lawyers and Alabama Super Lawyers.


  • Advised physician-hospital organization on regulatory compliance and antitrust issues for a Georgia tax-exempt health system
  • Provided special regulatory and transactional counsel to a leading provider of kidney dialysis services and renal care products in connection with its acquisition of a privately held renal care company
  • Successfully obtained Certificates of Need and Letters of Non-Reviewability in three separate states
  • Senior counsel for a series of acute care hospital divestitures for investor-owned hospital companies
  • Represented public healthcare authority in the re-purchase of a rural acute care hospital from a regional tax-exempt healthcare system
  • Formed and provides ongoing counsel to an independent practice association affiliated with a multi-hospital joint venture in Alabama involving both investor-owned and tax-exempt hospital systems

Colin, his wife Ashley, and children Catherine and Robert, enjoy life in Birmingham. An elder at Third Presbyterian Church, Colin also enjoys playing tennis, traveling, and reading about American and British history.  Though he's not interested in running for office, per se, he does enjoy politics and working behind-the-scenes on campaigns and initiatives.
