Jamie McGonigal’s practice is focused on complex commercial disputes, arbitrations, and litigation. She has extensive experience representing both plaintiffs and defendants from a variety of industries in matters that include breaches of contract, business torts, construction and real estate disputes, securities disputes, contested estate and trust proceedings (including will contests and litigation involving powers of attorney), and civil appeals.
Throughout her career Jamie has routinely represented closely held businesses and their owners or officers in contentious disputes that often involve demands for access to books and records, demands for accountings, disputes relating to shareholder agreements including buy-out provisions, shareholder derivative claims, business divorces or breakups, breaches of fiduciary duty, common law and statutory fraud claims, and theft of trade secrets and proprietary information. Jamie has often sought and defended against temporary injunctive relief and/or prevented spoliation of evidence in these cases through implementation of records preservation protocols on the defense side and through demands for preservation of records and related court filings on the plaintiff side.
Corporations, broker dealers, registered investment advisors, and other market participants rely on Jamie in securities litigation and FINRA arbitrations, often involving suitability, churning, unauthorized account activity, custody issues, conflicts of interest, breaches of fiduciary duty, fraud and negligent representation.

Before joining Waller, Jamie was a partner with Taube Summers Harrison Taylor Meinzer Brown, LLP, a preeminent bankruptcy and civil litigation boutique firm in Austin, Texas, where she practiced for 16 years.
In her free time, Jamie enjoys running, yoga, various other sports and outdoor activities, live music and other cultural events in Austin, and travel.
